Agreement- Www.i93.com provides web services inc. but not limited to web site design, hosting services, listing services and marketing. This agreement sets forth the Terms and Conditions which apply to the customer for use of www.i93.com services. The customer is deemed to have agreed to comply with all terms by use of the service.

Account Payment Terms-- A customer must pay fees per www.i93.com's current rate schedule as a condition to obtaining access to services. Rate changes will be effective when published on-line or otherwise provided to customers. A customers payment for is due within 10 days of invoicing. If payments are not received the account is subject to interruption of services. Payment terms of monthly fees are net 10 days. Payments not made within 30 days of billing date are considered delinquent. Delinquent accounts are subject to immediate suspension and/or termination without notice. Monthly charges will not be prorated on delinquent accounts. Either customer or www.i93.com may, at its sole discretion, terminate or suspend account(s) at any time with or without reason. TERMINATION OR SUSPENSION DOES NOT RELEASE LIABILITY FOR CHARGES DUE. Www.i93.com may delete all data, files or other information that is stored in customer's account upon suspension or termination.

Returned Checks- A returned check charge of $25.00 will be incurred for all returned checks plus bank, collections, and interest fees.

Billing Disputes- All billing disputes, with www.i93.com, must be received at our business office in writing and the obligation to pay for service will continue until such notice is received. Termination of your service does not constitute relief from amounts incurred prior to termination. Agreements or contracts not on a monthly basis (yearly, quarterly, etc...) can be canceled in writing or by phone, but the customer will be obligated to pay any and all monthly fees until termination of the contract is finalized.

Cancellation Policy- On cancellation; accounts will be billed to the end of their present billing cycle or anniversary date.  The pay in advance option has been developed as a discount program rated according to months paid in advance.  If this accounts is canceled it will be billed to the end of the present billing cycle and the charges will revert to full rate charges for the months used. 

Changes to Service-- The services provided by www.i93.com and our system(s) are expected to change from time to time. Www.i93.com reserves the right to change any service offered or the features of any service offered or its system without notice, including changes to access and use procedures.

Legality of Content- The customer agrees to use www.i93.com services for lawful purposes only. The customer will not post or transmit any material, through www.i93.com, which violates or infringes upon the rights of other users. This includes, but is not limited to: threatening, abusive, defamatory, vulgar or obscene language, any action which threatens public or private rights or which is considered objectionable, any action which encourages a criminal offense, any action which gives rise to civil liability or violates any law. Attempts to gain unauthorized access to outside business systems are expressly prohibited. Users agree to abide by any and all rules of the network(s) accessed via www.i93.com. The customer agrees to defend and hold harmless www.i93.com, its members, officers, employees, agents or affiliates for all damages and claims that might arise from the customers use or misuse of the service, which damages or otherwise harms either the customer, www.i93.com or a third party.

Responsibilities- Www.i93.com makes no warranties, expressed or implied, regarding services provided. www.i93.com is not responsible for any damages suffered from the use of our services, including but not limited to, loss of data, service interruptions and/or delays, or third party litigation.

Content Screening and Confidentiality-  Www.i93.com cannot and does not control the content of information available over the Internet. For this reason, the customer certifies that he/she is at least 18 years of age or, if the customer is a parent or guardian, he/she assumes all responsibility for supervising the on-line activities of the underage user. Any information garnered through www.i93.com is done so at your own risk. Www.i93.com does not guarantee the privacy or confidentiality of electronic mail and/or other transmissions over the Internet.

Unauthorized Usage- The customer shall not allow unauthorized unauthorized reselling or transferring of www.i93.com account(s), or the solicitation of www.i93.com users to become customers to other web service providers in competition with www.i93.com, nor shall the customer make any unauthorized copies or duplications of any www.i93.com material, advertising, forms, brochures, pamphlets and the like which is the property of www.i93.com.

Relationship- The relationship between the customer and www.i93.com is that of customer and web service provider only. In the event of a violation of any terms and/or conditions set forth in this agreement, www.i93.com reserves the right to immediately terminate the services provided to the customer, with the customer being fully responsible for any and all attorney's fees incurred by www.i93.com with regard to this agreement at all trial and appellate court levels.

Court Venue- In the event of a dispute, www.i93.com and the customer agree that the venue for such litigation shall be Grafton County in New Hampshire and that the terms and conditions of this agreement shall be interpreted under the laws of the State of New Hampshire.

SPAM Policy- The transmission of any type of material, whether graphical or textual in content, to other customers or non-customers without their express consent is prohibited under the terms of this agreement. Any violations of our SPAM policy will result in immediate termination. Any complaints received from our customers or non-customers of unsolicited materials will result in a charge of $150.00 per complaint charged to the offending customers account automatically.

Unauthorized use of Global Net Equipment- Any customer attempting to attack www.i93.com equipment in any way will be billed at $250.00 per hour, with a minimum billable time period of 1 hour, to track the offending customer and repair any damage they may have caused.

Modification of Terms-Www.i93.com reserves the right to change or modify the terms, conditions, rates or services at any time, without any prior notification.

No Warranty: Limitation of Liability- Use of www.i93.com's web services and system(s) and the internet in general is at the customers sole risk. Www.i93.com does not do not warrant that its services and system will be uninterrupted or error free; nor does www.i93.com make any warranty as to the results or information obtained from use of its services or system(s) or the Internet in general. Www.i93.com services and system(s) are provided on an "as is", "as available" basis without representation or warranties of any kind, either expressed or implied, including implied warranties of merchantability or fitness for a particular purpose, all of which warranties are hereby expressly disclaimed except to the extent any warranty cannot be disclaimed under applicable law in the State of NH. Under no circumstances shall www.i93.com be liable for any indirect, incidental, special or consequential damages, including without limitation, loss of profits, the maximum liability of any kind, to any customer or user for any and all loss, claim, damage, or liability of any kind, including due to www.i93.com negligence shall be limited to the amount paid by the customer or user to www.i93.com during the six month period preceding the claim.

Indemnity- The customer agrees to indemnify and hold all www.i93.com parties harmless from any and all claims, liabilities, damages, and/or expenses; including but not limited to attorney fees arising from or resulting thereof a customer’s account usage where it is authorized or in misconduct.

Interpretation-.-These terms and conditions set forth here supersede all other written and oral communications or agreements with regard to this subject matter. A waiver or modification of these terms and conditions shall only be effective if in writing and signed by an authorized agent of www.i93.com. These terms and conditions shall be governed by and interpreted in accordance with the laws of the State of New Hampshire without regard to choice of law principles.
